Welcome to Lac Crado Luxury. By accessing or using our website, social media pages, or consignment services (collectively, the “Services”), you agree to these Terms & Conditions. Please read them carefully as they govern your relationship with us.


1. Introduction & Agreement to Terms

  • These Terms & Conditions constitute a legally binding agreement between you (“Customer,” “Consignor,” or “User”) and the Company.

  • By purchasing or consigning items with us, you acknowledge that you have read, understood, and agree to comply with these Terms.


2. Business Nature & Services

  • The Company operates as a luxury secondhand retailer and consignment service provider, specializing in authentic pre-owned luxury goods.

  • We are not affiliated, associated, or endorsed by any brands whose products appear in our store, on our website, or on our social media pages

3. Product Authenticity & Representation 

3.1 Authentication Standards

  • Every product undergoes a multi-step authentication process before being accepted for consignment or listed for sale.

  • Our team uses industry-standard tools such as professional authentication devices (e.g., Entrupy, AI image scanning tools), brand-specific reference guides, and trained authenticators to verify the legitimacy of each item.

  • Where needed, we also engage third-party authentication companies for additional verification and documentation.

3.2 Proof of Authenticity

  • Upon request, we can provide authentication certificates from trusted third-party authenticators.

  • Buyers are advised to retain this documentation for their own records, especially if they wish to resell the item in the future.

3.3 Accuracy of Listings

  • We make every effort to ensure that product descriptions, photos, and condition ratings are accurate, detailed, and transparent.

  • Photos shown on our website or social media reflect the actual item being sold; we do not use stock images unless explicitly stated.

3.4 Condition Grading System

  • Each product is categorized using a standardized condition grading system (e.g., Brand New, Like New, Excellent, Good, Fair).

  • Condition notes will highlight any wear, scratches, or alterations so buyers can make informed decisions.

3.5 Buyer’s Responsibility

  • Buyers are encouraged to review all photos, descriptions, and condition notes carefully before making a purchase.

  • Requests for additional photos or videos of the product are welcome before finalizing the transaction.

3.6 Counterfeit Policy

  • We maintain a zero-tolerance policy toward counterfeit items.

  • If any item is proven to be counterfeit by a reputable authentication company after sale, the buyer will receive a full refund, and the item will be returned to the consignor at their expense.

  • Consignors found repeatedly providing counterfeit items will be permanently banned from our platform, and we may report such cases to the relevant authorities.

3.7 Limitation of Liability for Authentication

  • While we take every measure to ensure authenticity, we rely on third-party authentication experts in some cases.

  • The Company cannot be held liable for rare authentication errors made by independent third-party services. However, we will work with the buyer in good faith to resolve disputes promptly and fairly.

4. Pricing, Payment & Fees 

4.1 Pricing Transparency

  • All prices are listed in Singapore Dollars (SGD) only.

  • Any shipping charges, customs duties, or import taxes for international buyers will be clearly indicated before payment.

  • For consignment items, the final selling price will be mutually agreed upon between the consignor and the Company in writing prior to listing.


4.2 Price Adjustments & Promotions

  • The Company reserves the right to adjust selling prices based on market demand, item condition, and brand trends.

  • Consignors will be notified in advance before any price changes for unsold items.

  • Promotions (e.g., discount codes, clearance sales) are at the Company’s discretion but will not affect the consignor’s agreed payout unless explicitly agreed upon.


4.3 Accepted Payment Methods

Currently, the Company only accepts:

  • Bank Transfers

  • Cash Payments (in-person at our designated location)

No other payment methods are accepted at this time. Customers and consignors will receive payment instructions upon order confirmation or sale completion.


4.4 Consignment Commission Structure

  • The Company charges a standard [e.g., 20–30%] commission on the final selling price.

  • High-value brands (e.g., Hermès, Chanel) may have custom commission rates agreed upon in advance.

  • Commission covers authentication, photography, marketing, storage, and sales handling costs.


4.5 Payout Terms for Consignors

  • Consignors will be paid within [5–10 business days] after the buyer’s payment clears and the sale is confirmed final.

  • Payouts will be made via bank transfer only; cash payouts are not provided for consignors unless mutually agreed in writing beforehand.

  • A sales report will be provided, detailing the selling price, commission deducted, and final payout amount.


4.6 Additional Service Fees

Optional services may incur extra fees, such as:

  • Express Authentication or Third-Party Certificates

  • Professional Cleaning/Restoration Services before listing

  • Priority Marketing Placement (e.g., Instagram features, homepage highlights)

All such fees will be communicated and agreed upon before they apply.


4.7 Currency Policy

  • All transactions, payouts, and refunds will be processed in SGD only.

  • The Company does not provide currency conversion services; any bank conversion fees remain the client’s responsibility.


4.8 Dispute Resolution for Payments

  • Any disputes regarding pricing, commissions, or payouts must be raised within 7 days of receiving the sales report or payout notification.

  • The Company will review and provide supporting documentation to resolve disputes promptly.

  • If a resolution cannot be reached, disputes will be governed by Singapore law as set out in Section 12.

5. Consignment Terms 

5.1 Ownership & Legal Responsibility

  • Consignors must confirm that they are the rightful owners or authorized agents of the items submitted for consignment.

  • The Company reserves the right to request proof of purchase or original receipts to verify ownership.

  • Consignors agree to indemnify the Company against any claims, disputes, or legal issues arising from ownership challenges.


5.2 Consignment Agreement & Documentation

  • Each consignment item will be recorded in a Consignment Agreement outlining:

    • Item details (brand, model, size, color, condition)

    • Agreed selling price or price range

    • Commission rate and any additional fees

    • Consignment period and payout terms

  • A copy of the agreement will be provided to the consignor for reference.


5.3 Consignment Period

  • The standard consignment period is [e.g., 60–90 days] from the date the item is received and authenticated.

  • The Company may extend the consignment period if mutually agreed upon with the consignor.


5.4 Pricing & Discounts

  • Selling prices are determined in mutual agreement with the consignor, considering:

    • Current market value

    • Brand popularity

    • Item condition and demand

  • The Company reserves the right to recommend price reductions for unsold items to facilitate sales, but no changes will be made without consignor approval.


5.5 Marketing & Promotion

  • Consigned items may be promoted on:

    • Company website

    • Instagram, Facebook, TikTok, or other social media platforms

    • In-store displays or pop-up events (if applicable)

  • High-end items may be included in premium marketing campaigns (e.g., influencer features) with consignor approval.


5.6 Unsold Items & Withdrawals

  • Consignors may request return of unsold items after the consignment period ends or with [e.g., 14 days] written notice before early withdrawal.

  • Any authentication or service fees incurred before withdrawal remain payable by the consignor.


5.7 Sale Confirmation & Payouts

  • Once an item is sold, the Company will notify the consignor immediately.

  • Payouts will be made within [e.g., 5–10 business days] after deducting agreed commissions and fees, via bank transfer only.


5.8 Counterfeit or Disputed Items

  • If an item is found to be counterfeit during authentication, it will be returned at the consignor’s expense.

  • Repeated submission of counterfeit items may result in termination of consignment privileges and possible reporting to relevant authorities.


6. Condition Disclosure 

6.1 Honest Representation

  • We strive to provide accurate and transparent descriptions for all items, including:

    • Brand, model, and material

    • Size and measurements

    • Visible signs of wear or alterations

    • Year of production (if available)


6.2 Condition Grading System

All items are categorized using a standardized grading system:

  • Brand New (BN): Unused, with original packaging and tags intact.

  • Like New (LN): Minimal to no signs of wear, near-perfect condition.

  • Excellent (EX): Very minor signs of wear, fully functional and presentable.

  • Good (GD): Noticeable signs of use but no major defects; still functional.

  • Fair (FR): Heavily worn, may require repairs, sold at discounted rates.

The grading reflects physical appearance and functional quality but remains subjective to professional assessment.


6.3 Photo & Video Evidence

  • High-resolution photos and videos will be provided for each item.

  • Buyers may request additional images or close-ups before confirming a purchase.


6.4 Buyer Acknowledgment

  • Buyers acknowledge that pre-owned items may have minor imperfections due to previous usage.

  • No returns will be accepted for issues clearly disclosed in the product description or photos.


6.5 Restoration & Cleaning Services

  • Optional cleaning, polishing, or minor repair services may be offered before listing, subject to separate fees and consignor approval.

  • The Company will not alter or repair items without written consent from the consignor.


6.6 Liability Disclaimer

  • While every effort is made to describe items accurately, the Company is not liable for subjective interpretations of condition by buyers or consignors.

  • Final sale conditions apply unless otherwise covered under the Returns & Refunds Policy (Section 7).

7. Returns, Refunds & Exchange Policy 

7.1 General Policy

  • All sales are final due to the pre-owned nature of luxury items.

  • Returns, refunds, or exchanges are not allowed for reasons such as change of mind, wrong size, or minor cosmetic imperfections that were disclosed prior to purchase.


7.2 Exceptional Circumstances

Refunds or exchanges will only be considered in the following cases:

  1. Authenticity Disputes:

    • If an item is proven to be counterfeit by a reputable, independent authentication company, the buyer will receive a full refund, including shipping costs.

  2. Material Misrepresentation:

    • If the item received is significantly different from the description provided (e.g., wrong model, undisclosed major damage).


7.3 Claim Process

  • Buyers must submit refund or exchange requests within 7 calendar days of receiving the item.

  • Requests must include:

    • Order number

    • Reason for return/refund

    • Supporting evidence (e.g., photos, third-party authentication reports)


7.4 Refund Approval & Processing

  • All claims will be reviewed within 5–7 business days upon receipt of supporting documentation.

  • If approved, refunds will be processed within 10–14 business days via the original payment method (bank transfer or cash).

  • For authenticity disputes, the buyer must return the item in the same condition as received before the refund is issued.


7.5 Non-Refundable Situations

  • Items damaged by improper handling after delivery.

  • Claims submitted after the 7-day window.

  • Subjective issues such as “item does not look the same in person” when all details were provided accurately in the listing.


7.6 Exchanges

  • Exchanges are not offered for pre-owned items due to the unique nature of each product.


7.7 Consignor Protection

  • Once a sale is completed and the return/refund window closes, the consignor payout will be processed.

  • Any refunds granted after consignor payout will be covered by the Company, not the consignor.


8. Shipping, Risk & Delivery 

8.1 Shipping Methods

  • We use reliable courier services such as DHL, FedEx, or local delivery partners for both domestic and international shipping.

  • Buyers can request express shipping at additional cost.


8.2 Delivery Timeline

  • Domestic deliveries: 2–5 business days after order confirmation.

  • International deliveries: 7–14 business days, depending on customs clearance.

  • Delivery timelines are estimates and may vary based on courier or customs delays.


8.3 Shipping Costs

  • Standard shipping fees are clearly stated at checkout or during the order process.

  • Buyers are responsible for any import duties, taxes, or customs clearance charges in their country.


8.4 Risk of Loss & Insurance

  • The Company ensures that all shipments are properly packaged to minimize risk of damage.

  • Risk transfers to the buyer once the courier confirms delivery at the specified address.

  • Insurance options for high-value items are available upon request at the buyer’s expense.


8.5 Tracking & Confirmation

  • Buyers will receive tracking numbers once the item is shipped.

  • For local deliveries, signed confirmation or photo proof of delivery may be required for high-value items.


8.6 Failed Deliveries & Address Issues

  • Buyers must provide accurate delivery information.

  • If a package is returned due to incorrect address details or unclaimed delivery, the buyer will bear re-shipping costs.


8.7 Lost or Damaged Shipments

  • In the rare event of a lost or damaged shipment:

    • The Company will assist in filing claims with the courier service.

    • Refunds or replacements will only be issued once the courier confirms the claim.


8.8 In-Person Collection

  • Buyers may request in-person collection for high-value items by appointment only, at a designated location agreed upon by the Company.

9. Intellectual Property & Branding

9.1 Company Intellectual Property

  • All content on the Company’s website, social media platforms, marketing materials, and documentation — including but not limited to text, images, videos, logos, designs, product descriptions, layouts, and branding elements — are the exclusive property of the Company.

  • Such content is protected by intellectual property laws in Singapore and internationally.


9.2 Restrictions on Use

  • No part of the Company’s content may be:

    • Reproduced

    • Distributed

    • Transmitted

    • Displayed publicly

    • Used for commercial purposes

  • …without prior written consent from the Company.


9.3 Trademarks & Brand Names

  • All third-party brand names (e.g., Hermès, Chanel, Louis Vuitton) appearing on the Company’s website or social media belong to their respective trademark owners.

  • The Company is not affiliated with, endorsed by, or an authorized retailer of these brands.

  • References to these brands are made solely for the purpose of accurately describing products offered for sale.


9.4 Prohibition on Misrepresentation

  • Customers and consignors may not use the Company’s name, logo, or marketing materials in any way that could misrepresent or damage the Company’s reputation.

  • Any unauthorized use may result in legal action and claims for damages.


9.5 Intellectual Property Infringement Claims

  • If you believe any content on our platforms infringes your intellectual property rights, please contact us immediately with:

    • A description of the alleged infringement

    • Supporting documentation

    • Your contact information

  • We will promptly investigate and, if necessary, remove the infringing content in compliance with applicable laws.


10. Limitation of Liability 

10.1 General Disclaimer

  • The Company provides consignment and sales services on an “as-is” and “as-available” basis.

  • While we take reasonable steps to ensure accuracy, authenticity, and safe transactions, we do not guarantee uninterrupted or error-free services.


10.2 Liability for Pre-Owned Items

  • The Company is not liable for:

    • Normal wear and tear on pre-owned items

    • Subjective dissatisfaction with product condition when accurately described and photographed

    • Any difference in color perception due to lighting, device screens, or photography settings


10.3 Indirect & Consequential Damages

  • To the fullest extent permitted by law, the Company shall not be liable for any:

    • Loss of profits

    • Business interruptions

    • Loss of goodwill or data

    • Indirect, incidental, or consequential damages arising out of the use of our services or products


10.4 Third-Party Services

  • Some services, such as authentication, shipping, or payment processing, may be performed by third-party providers.

  • The Company shall not be responsible for delays, errors, or losses attributable to these third parties, though we will assist customers in resolving such issues where possible.


10.5 Liability Cap

  • In any case, the Company’s total liability for any claim shall not exceed the total purchase price paid by the buyer for the disputed item.


10.6 Legal Compliance & Indemnity

  • Customers and consignors agree to indemnify and hold the Company harmless against any claims, damages, liabilities, or expenses arising from:

    • Breach of these Terms & Conditions

    • Submission of counterfeit or stolen goods

    • Misuse of the Company’s services or intellectual property

11. Privacy & Data Protection 

11.1 Commitment to Privacy

  • The Company respects the privacy of all customers, consignors, and website visitors.

  • We are committed to handling personal data responsibly, securely, and in compliance with Singapore’s Personal Data Protection Act (PDPA) and other applicable laws.


11.2 Types of Data Collected

We may collect the following information:

  • Contact Information: Name, phone number, email address, mailing address

  • Transaction Details: Order history, consignment agreements, payment records

  • Website Usage Data: Cookies, browsing behavior, IP addresses for analytics and security


11.3 Purpose of Data Collection

Your data may be used for:

  • Processing sales, consignments, and payouts

  • Providing customer support and after-sales services

  • Sending transaction updates, order confirmations, or shipping details

  • Marketing communications (only with your explicit consent)

  • Regulatory compliance and fraud prevention


11.4 Data Storage & Security

  • All personal data is stored on secure servers with encryption and access controls.

  • Only authorized employees and third-party service providers (e.g., couriers, payment processors) have access to necessary information.


11.5 Data Sharing & Third Parties

  • We do not sell or rent personal data to third parties.

  • Limited data may be shared with:

    • Shipping partners for delivery

    • Payment providers for transaction processing

    • Legal authorities if required by law


11.6 Customer Rights

  • Customers have the right to:

    • Request access to their data

    • Request correction of inaccurate data

    • Withdraw consent for marketing communications at any time


11.7 Data Retention

  • Personal data is retained only as long as necessary for business or legal purposes.

  • Once no longer required, data is securely deleted or anonymized.


12. Governing Law & Dispute Resolution 

12.1 Governing Law

  • These Terms & Conditions shall be governed by and interpreted in accordance with the laws of Singapore.


12.2 Dispute Resolution Process

  • Both parties agree to first attempt to resolve disputes amicably through negotiation.

  • If a resolution cannot be reached, disputes will be referred to mediation or arbitration in Singapore, administered by the Singapore Mediation Centre (SMC) or Singapore International Arbitration Centre (SIAC).


12.3 Jurisdiction

  • Any disputes not resolved through mediation or arbitration shall be submitted to the exclusive jurisdiction of the courts of Singapore.


12.4 Language

  • These Terms & Conditions are drafted in English.

  • If translated into other languages, the English version shall prevail in case of discrepancies.


12.5 Costs

  • Each party shall bear its own costs for negotiation or mediation.

  • Arbitration or litigation costs will be allocated as determined by the relevant tribunal or court.


13. Updates to Terms 

13.1 Right to Amend

  • The Company reserves the right to amend, update, or modify these Terms & Conditions at any time without prior notice.

  • Changes may be required due to business needs, legal updates, or operational improvements.


13.2 Notification of Changes

  • Any material changes will be published on our website and, where applicable, communicated via email or official channels.

  • The “Effective Date” at the top of the Terms & Conditions will be updated whenever revisions are made.


13.3 Continued Use

  • By continuing to use our services after any changes, you agree to the revised Terms & Conditions.

  • If you do not agree with the changes, you must stop using our services immediately.
